Key Cases

Nick Murdock has lived and practiced law in Wyoming for almost three decades. His practice focuses on difficult litigation, both in the commercial and personal injury areas. The Murdock Law Firm is rightfully proud of its clients' successes in large, complex lawsuits. But it also treasures the relief and satisfaction it has brought in less complicated cases.

Here are some of Murdock's more significant matters:
  • Wilson vs. Amoco, involving the Casper, Wyoming, refinery. While the litigation ultimately resulted in class damages for people in north Casper and property owners around the refinery property, the case resulted in the community having a say in the development of the refinery property. Today, many Resource Conservation and Recovery Act (RCRA) remediation agreements now contain a clause called the "Casper provision," which calls for community decision-making concerning the remediation and use of the property. (Wilson vs. Amoco Corp, 989 F. Supp. 1159, D. Wyo. 1998.)
  • Wold vs. Hunt Oil, involving the issue of deductions taken from royalty owner. This was one of the first casess to examine the provisions of the 1989 amendments to the Wyoming Royalty Payment Act. (Wold vs. Hunt Oil Co., 52 F. Supp. 2d 1330. D. Wyo. 1999.)
  • EPA vs. Conoco, involving novel issues of RCRA liability and contribution by other responsible parties. This litigation was multi-phased and continued into a suite over insurance coverage for the operator. (U.S. vs. Valentine, 856 F. Supp. 627, D. Wyo. 1994.)
  • Spratt vs. BHP, involving a very complicated financial case in which a recalculation of royalties was erroneously done, partially arising out of Okie vs. BHP. (BHP Petroleum Co., vs. Okie, 836 P.2d 873, Wyo. 1992.)
  • The Brookhurst litigation, involving the contamination of a water supply, complex and difficult groundwater hydrology, health risk analysis, multiple contamination sources, and remediation issues.
  • Williams vs. Vail Resorts Development Company, et al, involving the carbon monoxide poisoning of Dr. Randall Williams and his wife, Joette, in a resort in Jackson, Wyoming, in 2001. Murdock tried the case, together with Bob Schuster, in November and December 2003. The jury awarded a verdict of $17.5 million--one of the largest verdicts in Wyoming. Schuster and Murdock continue to work on other carbon monoxide poisoning cases in Wyoming and other states.
